1. Who We Are

This website and online store (the "Store") is operated by Snugly ("Snugly," "we," "us," or "our"), a sole proprietorship based in the State of Indiana, United States. The Store is hosted on Shopify. These Terms of Service ("Terms") govern your use of the Store and any purchase you make from us.

2. Agreement to These Terms

By visiting the Store or placing an order, you agree to these Terms, our Privacy Policy, our Refund Policy, and our Shipping Policy, which are part of these Terms. If you do not agree, please do not use the Store.

3. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order. By placing an order, you confirm that you meet this requirement and that the information you give us is accurate and complete.

4. Products and Descriptions

We try to describe and photograph our products as accurately as possible. However, colors may look different depending on your screen, and some products are naturally variable. For example, moving sand products create a different pattern every time they are used, so the scenes you see will not exactly match our photos or videos. Measurements and specifications are approximate. Product images and videos are for illustration and may show items in staged settings.

5. Product Use and Safety

Please read and follow any instructions and warnings that come with your product. Some products contain glass or electrical components and should be handled with care, kept away from water, used only with an appropriate power source, and kept out of reach of small children and pets. Our products are home decor items, not toys. Do not use a product that is cracked, leaking, or damaged; contact us instead. We are not responsible for injury or damage caused by misuse, modification, accidents, or failure to follow instructions.

6. Pricing and Availability

All prices are in U.S. dollars and may change at any time without notice. Products are subject to availability. Despite our efforts, an item may occasionally be listed with an incorrect price or description. If that happens, we may cancel any order for that item, even after it has been confirmed, and refund any amount you paid. Discount codes cannot be combined unless stated, have no cash value, and may be changed or ended at any time.

7. Orders and Payment

Your order is an offer to buy. We may accept, limit, or cancel any order for any reason, including suspected fraud, errors, or stock problems. If we cancel an order after you have been charged, we will refund the full amount to your original payment method. Payments are processed securely by our payment providers; we do not store your full card details.

8. Shipping, Returns, and Refunds

Shipping is covered by our Shipping Policy, and returns and refunds are covered by our Refund Policy. Delivery times are estimates and are not guaranteed. Some products are shipped directly from our suppliers' warehouses.

9. Intellectual Property

The Snugly name, logo, and the text, graphics, and other content we created for the Store belong to us or our licensors and may not be copied or used without our written permission.

10. Acceptable Use

You agree not to use the Store for any unlawful purpose, to submit false orders or information, to interfere with the Store's security or operation, or to copy or scrape its content.

11. Third-Party Links and Services

The Store may link to or rely on third-party websites and services, such as payment processors, shipping carriers, and social media platforms. We do not control them and are not responsible for their content, policies, or actions.

12. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE STORE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," AND WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, EXCEPT AS EXPRESSLY STATED IN OUR REFUND POLICY. SOME STATES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SNUGLY AND ITS OWNER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE STORE OR ANY PRODUCT. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE STORE OR A PRODUCT WILL NOT EXCEED THE AMOUNT YOU PAID FOR THAT PRODUCT. SOME STATES DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU. NOTHING IN THESE TERMS LIMITS ANY LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

14. Indemnification

You agree to indemnify and hold harmless Snugly and its owner from any claims, losses, or expenses, including reasonable attorneys' fees, arising from your violation of these Terms, your misuse of a product, or your violation of any law or the rights of another person.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Indiana, without regard to its conflict-of-law rules. Before filing any claim, you agree to contact us first so we can try to resolve the issue informally. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Indiana, and you consent to their jurisdiction, except that either party may bring an individual claim in small claims court where it qualifies. Nothing in this section limits any rights you have under the consumer protection laws of the state where you live.

16. Changes to These Terms

We may update these Terms at any time by posting the new version on this page and changing the "Last updated" date. The Terms in effect when you place an order apply to that order.

17. Severability

If any part of these Terms is found unenforceable, the rest will remain in full effect.
